New Seller Disclosure Rules in QLD: What Sunshine Coast Homeowners Need to Know Before Selling

From 1 August 2025, all property sellers in Queensland must comply with a major legal change: you’ll need to give buyers a Seller Disclosure Statement before they sign a contract.

If you’re thinking about selling your home on the Sunshine Coast, this affects you — and preparation now could save you time and stress later.

βœ… What’s Changing?

The new Property Law Act 2023 introduces a mandatory Seller Disclosure Statement (Form 2) for residential property sales. This form provides buyers with key information about the property before they sign a contract.

It’s designed to promote transparency and reduce disputes later in the transaction process.

Sellers will now need to disclose (and supply evidence of):

  • Title and registered plan details

  • Encumbrances, leases or agreements (registered or not)

  • Zoning and environmental matters

  • Notices from government bodies (e.g. tree or contamination notices)

  • Pool safety certificates

  • Rates and water charges

  • Tenancy history (if applicable)

  • Body corporate documents (if applicable)

Buyers are strongly encouraged to still carry out independent checks (e.g. building & pest reports), but as a seller, you must legally provide the required documents and disclosures as part of Form 2.

This is now a legal requirement. If the disclosure isn’t given properly:

  • A buyer may be able to terminate the contract.

  • The sale may be delayed or fall through altogether.

  • You may face legal or financial consequences for non-compliance.
